Terms of Service for Menu Translator

Welcome to Menu Translator, an application operated by CurlyCorn LLC ("we," "us," or "our"). By accessing or using our application, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use our application.
1. Service Description
Menu Translator is an application that uses artificial intelligence to process and translate images of menus uploaded by users. We utilize OpenAI's technology to provide this service.
2. User Responsibilities
2.1. You are responsible for any content you upload to our application.
2.2. You agree not to use our application for any illegal or unauthorized purpose.
2.3. You must not transmit any worms, viruses, or any code of a destructive nature.
3. Intellectual Property
3.1. The application and its original content, features, and functionality are owned by CurlyCorn LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4. Data Processing and Storage
4.1. We do not store the images or menu content you upload. These are relayed between you and OpenAI for processing.
4.2. We use ElevenLabs for generating audio of the pronunciation of dish names. Only the dish title is sent to ElevenLabs for this purpose.
4.3. Dietary restrictions enabled in the settings and your location are not stored by us but are transferred to OpenAI to improve personalized menu processing.

5. Subscriptions and Payments
5.1. We offer paid subscriptions that can be purchased through the Apple App Store or Google Play Store.
5.2. Subscriptions automatically renew either monthly or annually, depending on the plan you choose.
5.3. Paid subscriptions include access to 50 scans per month and the ability to listen to pronunciations of dish names.
5.4. You can modify, cancel, or pause your subscription through the App Store or Google Play Store, depending on where you made the purchase.
5.5. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
5.6. Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
5.7. Your account will be charged for renewal within 24-hours prior to the end of the current period.
5.8. You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.
5.9. No refund will be provided for the unused portion of the term.
5.10. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
6. Dietary Information and User Responsibility
6.1. Any dietary information or estimates provided by the application (including but not limited to vegan, vegetarian, or allergen information) are based on similar dishes in other restaurants and may not be accurate for the specific dish in question.
6.2. It is the user's sole responsibility to confirm all dietary information with the restaurant staff before consuming any food.
6.3. We do not guarantee the accuracy of any dietary information provided and do not accept any liability for decisions made based on this information.
7. Disclaimer of Warranties
7.1. The application is provided on an "as is" and "as available" basis without any warranties of any kind.
7.2. We do not warrant the accuracy, reliability, or completeness of any translations or information provided through our application.
7.3. Image recognition and AI technologies are not 100% reliable. Errors may occur, including but not limited to:
- Incorrect identification of dishes
- Inaccurate pricing information
- Incorrect classification of dishes as vegan, vegetarian, or containing specific ingredients (e.g., pork)
8. Limitation of Liability
8.1. To the fullest extent permitted by applicable law, CurlyCorn LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
a) Your use or inability to use the application
b) Any inaccuracies or errors in the translations or information provided
c) Any decisions made or actions taken based on the information provided by the application, including dietary information
9. Indemnification
You agree to indemnify and hold CurlyCorn LLC, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the application.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. It is your responsibility to check these Terms periodically for changes.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Mexico, without regard to its conflict of law provisions.
